Jak to tak s\u00a0<i>dezinformacemi<\/i>\u00a0b\u00fdv\u00e1, st\u00e1vaj\u00ed se\u00a0<i>informacemi<\/i>\u00a0a\u017e se zpo\u017ed\u011bn\u00edm a tak se poj\u010fme pod\u00edvat, co na n\u00e1s EU skute\u010dn\u011b chyst\u00e1.<\/p>\n<p>Na \u00favod prohl\u00e1\u0161en\u00ed: monstr\u00f3zn\u00ed a bezprecedentn\u00ed z\u00e1sah do pr\u00e1v majitel\u016f automobil\u016f a trhu s\u00a0ojetinami a n\u00e1hradn\u00edmi d\u00edly je natolik \u0161irok\u00fd, \u017ee nen\u00ed mo\u017en\u00e9 jej v\u00a0jednom \u010dl\u00e1nku detailn\u011b rozebrat s\u00a0dopady do v\u0161ech oblast\u00ed, kter\u00fdch se bude t\u00fdkat. Vyb\u00edz\u00ed k\u00a0mnoha interpretac\u00edm, co se m\u016f\u017ee st\u00e1t a teprve \u010das uk\u00e1\u017ee, jak\u00e1 bude implementace do praxe. Proto je c\u00edlem \u010dl\u00e1nku pouze upozornit na (z m\u00e9ho pohledu) nejz\u00e1va\u017en\u011bj\u0161\u00ed \u010d\u00e1sti, kter\u00e9 dopadnou na v\u0161echny, i na ty, kte\u0159\u00ed si nejsp\u00ed\u0161 mysleli, \u017ee maj\u00ed relativn\u011b nov\u00e9 auto a syst\u00e9m jim d\u00e1 pokoj.<\/p>\n<p>K\u00a0z\u00e1sahu do\u0161lo loni v\u00a0l\u00e9t\u011b \u2013 konkr\u00e9tn\u011b\u00a0<i><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/CS\/TXT\/?uri=CELEX:52023PC0451\">NA\u0158\u00cdZEN\u00cd EVROPSK\u00c9HO PARLAMENTU A RADY o po\u017eadavc\u00edch na ob\u011bhovost projekt\u016f vozidel, o nakl\u00e1d\u00e1n\u00ed s vozidly s ukon\u010denou \u017eivotnost\u00ed, o zm\u011bn\u011b na\u0159\u00edzen\u00ed (EU) 2018\/858 a (EU) 2019\/1020 a zru\u0161en\u00ed sm\u011brnic 2000\/53\/ES a 2005\/6<\/a>\u00a0<\/i>nese datum 23.7.2023. Kdo m\u00e1 z\u00e1jem, m\u016f\u017ee se pustit do studia, \u010dek\u00e1 na n\u011bj n\u011bco p\u0159es 100 stran a skoro 45000 slov hodnotn\u00e9ho textu, pln\u00e9 vysoce konkr\u00e9tn\u00edch v\u011bt jako\u00a0<i>\u201evozidla by m\u011bla b\u00fdt projektov\u00e1na a vyr\u00e1b\u011bna tak, aby byla omezena p\u0159\u00edtomnost l\u00e1tek vzbuzuj\u00edc\u00edch obavy\u201c<\/i>.<\/p>\n<p>Kdy\u017e \u00fa\u0159edn\u00edk zasedne do zam\u011bstn\u00e1n\u00ed, je z\u0159ejm\u00e9, \u017ee vzniknou nov\u00e1 na\u0159\u00edzen\u00ed, kter\u00e1 budou\u00a0<i>m\u00edt \u201ekr\u00e1tkodob\u00e9 a st\u0159edn\u011bdob\u00e9 n\u00e1klady\u201c<\/i>, po kter\u00fdch nastane\u00a0<i>\u201edlouhodob\u00e1 konkurenceschopnost\u201c<\/i>. Bude v\u00edce\u00a0<i>digitalizace<\/i>\u00a0a\u00a0<i>spolupr\u00e1ce<\/i>\u00a0v\u00a0r\u00e1mci\u00a0<i>\u201ejednotn\u00e9ho trhu EU\u201c.<\/i>\u00a0Bude tak\u00e9 v\u00edce bum\u00e1\u017eek pro ty spr\u00e1vn\u00e9 firmy, kter\u00e9\u00a0<i>\u201e\u2026maj\u00ed technickou, finan\u010dn\u00ed a organiza\u010dn\u00ed kapacitu pot\u0159ebnou k prov\u00e1d\u011bn\u00ed operac\u00ed zpracov\u00e1n\u00ed vozidel s ukon\u010denou \u017eivotnost\u00ed\u2026\u201c<\/i>. A bude p\u0159edev\u0161\u00edm nov\u00e1 my\u0161lenka, jak vyhodnotit auto \u201es ukon\u010denou \u017eivotnost\u00ed\u201c.<\/p>\n<p>Pro \u0159\u00e1dnou funkci bude nutn\u00e9 zav\u00e9st oznamov\u00e1n\u00ed. To je ji\u017e v\u00a0na\u0161\u00ed kotlin\u011b dob\u0159e zako\u0159en\u011bno, a tak nikoho nep\u0159ekvap\u00ed, \u017ee \u201e<i>finan\u010dn\u00ed p\u0159\u00edsp\u011bvky v\u00fdrobc\u016f by m\u011bly rovn\u011b\u017e pokr\u00fdt n\u00e1klady na vzd\u011bl\u00e1vac\u00ed kampan\u011b zam\u011b\u0159en\u00e9 na\u00a0<\/i><i><b>zv\u00fd\u0161en\u00ed sb\u011bru vozidel s ukon\u010denou \u017eivotnost\u00ed, zaveden\u00ed syst\u00e9mu oznamov\u00e1n\u00ed pro vyd\u00e1v\u00e1n\u00ed a p\u0159ed\u00e1v\u00e1n\u00ed osv\u011bd\u010den\u00ed o likvidaci a shroma\u017e\u010fov\u00e1n\u00ed a hl\u00e1\u0161en\u00ed \u00fadaj\u016f p\u0159\u00edslu\u0161n\u00fdm org\u00e1n\u016fm<\/b><\/i><i>.\u201c<\/i><\/p>\n<p>Nov\u00e9 zodpov\u011bdnosti padnou tak\u00e9 na v\u00fdrobce a bude jist\u011b zaj\u00edmav\u00e9 sledovat, jak se jich zhost\u00ed. Nap\u0159\u00edklad tu m\u00e1me \u010dast\u00fd dovoz vozidel ze zahrani\u010d\u00ed:\u00a0<i>\u201ejeliko\u017e vozidla se \u010dasto st\u00e1vaj\u00ed vozidly s ukon\u010denou \u017eivotnost\u00ed v jin\u00e9m \u010dlensk\u00e9m st\u00e1t\u011b ne\u017e v \u010dlensk\u00e9m st\u00e1t\u011b, kde byla poprv\u00e9 registrov\u00e1na,\u00a0<\/i><i><b>je nezbytn\u00e9 zav\u00e9st pravidla pro p\u0159eshrani\u010dn\u00ed roz\u0161\u00ed\u0159enou odpov\u011bdnost v\u00fdrobce<\/b><\/i><i>.\u201c<\/i><\/p>\n<p>N<span lang=\"pl-PL\">yn<\/span>\u00ed tedy ji\u017e k\u00a0tomu nejpodstatn\u011bj\u0161\u00edmu. Jak pozn\u00e1te, \u017ee m\u00e1te auto \u201es ukon\u010denou \u017eivotnost\u00ed\u201c a co budete muset ud\u011blat? Neopravitelnost vozidla m\u016f\u017ee b\u00fdt technick\u00e1 nebo ekonomick\u00e1:<\/p>\n<p>\u201e<i>Vozidlo je\u00a0<\/i><i><b>technicky neopraviteln\u00e9<\/b><\/i><i>, pokud spl\u0148uje jedno nebo v\u00edce z t\u011bchto krit\u00e9ri\u00ed:<\/i><\/p>\n<p><i>e) nelze opravit nebo vym\u011bnit jednu nebo v\u00edce z t\u011bchto konstruk\u010dn\u00edch \u010d\u00e1st\u00ed vozidla:<\/i><\/p>\n<ul>\n<li><i>ii)\u00a0<\/i><i><b>konstruk\u010dn\u00ed \u010d\u00e1sti spojen\u00ed se zem\u00ed (jako jsou pneumatiky a kola), odpru\u017een\u00ed, \u0159\u00edzen\u00ed, brzdy<\/b><\/i><i>\u00a0a jejich ovl\u00e1dac\u00ed prvky;<\/i><\/li>\n<li><i>ii)\u00a0<\/i><i><b>upevn\u011bn\u00ed<\/b><\/i><i>\u00a0a spoje\u00a0<\/i><i><b>sedadel<\/b><\/i><i>;<\/i><\/li>\n<li><i>iii)\u00a0<\/i><i><b>airbagy<\/b><\/i><i>, p\u0159edp\u00edna\u010de, bezpe\u010dnostn\u00ed p\u00e1sy a jejich perifern\u00ed ovl\u00e1dac\u00ed prvky;<\/i><\/li>\n<li><i>iv) korba a\u00a0<\/i><i><b>podvozek<\/b><\/i><i>\u00a0vozidla;<\/i><\/li>\n<\/ul>\n<p><i>f) jeho konstruk\u010dn\u00ed a bezpe\u010dnostn\u00ed sou\u010d\u00e1sti maj\u00ed technick\u00e9 z\u00e1vady, kter\u00e9 jsou nevratn\u00e9 a \u010din\u00ed je nevym\u011bniteln\u00fdmi<\/i><i><b>, nap\u0159. st\u00e1rnut\u00ed kovu<\/b><\/i><i>, n\u011bkolikan\u00e1sobn\u00e9 poru\u0161en\u00ed z\u00e1kladn\u00edho n\u00e1t\u011bru nebo nadm\u011brn\u00e1 perfora\u010dn\u00ed koroze;<\/i><\/p>\n<p><i><b>g) jeho oprava vy\u017eaduje v\u00fdm\u011bnu motoru, p\u0159evodovky, karoserie nebo sestavy podvozku<\/b><\/i><i>, co\u017e vede ke ztr\u00e1t\u011b p\u016fvodn\u00ed identity vozidla.<\/i><\/p>\n<p><i>2.Vozidlo je\u00a0<\/i><i><b>ekonomicky neopraviteln\u00e9<\/b><\/i><i>, pokud je jeho tr\u017en\u00ed hodnota ni\u017e\u0161\u00ed ne\u017e n\u00e1klady na nezbytn\u00e9 opravy pot\u0159ebn\u00e9 k jeho obnov\u011b v Unii do technick\u00e9ho stavu, kter\u00fd by posta\u010doval k\u00a0<\/i><i><b>z\u00edsk\u00e1n\u00ed osv\u011bd\u010den\u00ed o technick\u00e9 zp\u016fsobilosti v \u010dlensk\u00e9m st\u00e1t\u011b, kde bylo vozidlo p\u0159ed opravou registrov\u00e1no<\/b><\/i><i>.<\/i><\/p>\n<p><i>3. Vozidlo lze pova\u017eovat\u00a0<\/i><i><b>za technicky neopraviteln\u00e9<\/b><\/i><i>, pokud:<\/i><\/p>\n<ul>\n<li><i>b)\u00a0<\/i><i><b>nem\u00e1 p\u0159imontovan\u00e9 dve\u0159e<\/b><\/i><i>;<\/i><\/li>\n<li><i>e) byly vypu\u0161t\u011bny provozn\u00ed kapaliny (palivo, brzdov\u00e1 kapalina, nemrznouc\u00ed kapalina, kyselina z akumul\u00e1toru, chladic\u00ed kapalina), co\u017e p\u0159edstavuje riziko zne\u010di\u0161t\u011bn\u00ed vody, nebo<\/i><\/li>\n<li><i>f)\u00a0<\/i><i><b>jeho brzdy a sou\u010d\u00e1sti \u0159\u00edzen\u00ed jsou nadm\u011brn\u011b opot\u0159ebovan\u00e9<\/b><\/i><i>.\u201c<\/i><\/li>\n<\/ul>\n<p>Zde si dovol\u00edm spekulaci, \u017ee takov\u00e9 \u201enadm\u011brn\u011b opot\u0159ebovan\u00e9\u201c brzdy nebo \u0159\u00edzen\u00ed hrav\u011b zhodnot\u00ed STK, se v\u0161\u00edm, co k\u00a0takov\u00e9 pravomoci pat\u0159\u00ed. Nicm\u00e9n\u011b to zat\u00edm nebylo stanoveno, tak\u017ee poj\u010fme d\u00e1l:<\/p>\n<p><strong>\u201e<i>ORIENTA\u010cN\u00cd SEZNAM KRIT\u00c9RI\u00cd PRO VOZIDLA S UKON\u010cENOU \u017dIVOTNOST\u00cd<\/i><\/strong><\/p>\n<p><i>Pro ur\u010den\u00ed toho, zda je ojet\u00e9 vozidlo vozidlem s ukon\u010denou \u017eivotnost\u00ed, mohou b\u00fdt pou\u017eita jako dal\u0161\u00ed od\u016fvodn\u011bn\u00ed i tato krit\u00e9ria:<\/i><\/p>\n<ul>\n<li><i>c) vozidlo nepro\u0161lo povinnou\u00a0<\/i><i><b>vnitrost\u00e1tn\u00ed technickou prohl\u00eddkou po dobu del\u0161\u00ed ne\u017e dva roky od data, kdy byla tato prohl\u00eddka naposledy po\u017eadov\u00e1na<\/b><\/i><i>;<\/i><\/li>\n<li><i>d) nen\u00ed n\u00e1le\u017eit\u011b chr\u00e1n\u011bno p\u0159ed po\u0161kozen\u00edm b\u011bhem skladov\u00e1n\u00ed, p\u0159epravy, nakl\u00e1dky a vykl\u00e1dky\u201c<\/i><\/li>\n<\/ul>\n<p>M\u00e1te na d\u00edln\u011b auto se zna\u010dkami v\u00a0depozitu, co \u201ejednou oprav\u00edte\u201c? \u0158ekl bych, \u017ee befehl k\u00a0n\u00e1stupu na \u0161ro\u0165\u00e1k p\u0159ijde d\u0159\u00edv, ale to je pouze spekulace. U tajupln\u00e9ho bodu d) m\u016f\u017eete tipovat v\u00a0diskusi, co se vlastn\u011b chyst\u00e1.<\/p>\n<p>Mo\u017en\u00e1 si \u0159\u00edk\u00e1te, \u017ee kdy\u017etak koup\u00edte n\u00e1hradn\u00ed d\u00edly z\u00a0boura\u010dek. \u00da\u0159edn\u00edk v\u0161ak myslel na v\u0161e. Zaprv\u00e9 stanovuje povinnosti pro prodej pou\u017eit\u00fdch ND, kter\u00e9 maj\u00ed dle m\u00e9ho skromn\u00e9ho n\u00e1zoru za c\u00edl zni\u010dit jejich soukrom\u00fd prodej:<\/p>\n<p>\u201e<i><b>jak\u00e1koli osoba<\/b><\/i><i>\u00a0obchoduj\u00edc\u00ed s pou\u017eit\u00fdmi, repasovan\u00fdmi nebo renovovan\u00fdmi n\u00e1hradn\u00edmi d\u00edly a konstruk\u010dn\u00edmi \u010d\u00e1stmi v m\u00edst\u011b prodeje: a) zajist\u00ed, aby byly d\u00edly a konstruk\u010dn\u00ed \u010d\u00e1sti ozna\u010deny v souladu s \u010d\u00e1st\u00ed D bodem 2 p\u0159\u00edlohy VII; b)\u00a0<\/i><i><b>poskytne<\/b><\/i><i>\u00a0na pou\u017eit\u00e9, repasovan\u00e9 nebo renovovan\u00e9 d\u00edly a konstruk\u010dn\u00ed \u010d\u00e1sti\u00a0<\/i><i><b>z\u00e1ruku<\/b><\/i><i>.\u201c<\/i><\/p>\n<p>Sou\u010dasn\u011b existuj\u00ed d\u00edly, kter\u00e9 se pou\u017e\u00edt op\u011btovn\u011b nesm\u00ed:<\/p>\n<ul>\n<li><i>V\u0161echny airbagy, v\u010detn\u011b pol\u0161t\u00e1\u0159ov\u00e1n\u00ed, pyrotechnick\u00fdch za\u0159\u00edzen\u00ed, elektronick\u00fdch \u0159\u00eddic\u00edch jednotek a sn\u00edma\u010d\u016f.<\/i><\/li>\n<li><i>Za\u0159\u00edzen\u00ed k n\u00e1sledn\u00e9mu zpracov\u00e1n\u00ed emis\u00ed (nap\u0159.\u00a0<\/i><i><b>katalyz\u00e1tory<\/b><\/i><i>, filtry \u010d\u00e1stic).<\/i><\/li>\n<li><i><b>Tlumi\u010de v\u00fdfuku<\/b><\/i><i>.<\/i><\/li>\n<li><i>Automatick\u00e9 nebo neautomatick\u00e9 syst\u00e9my bezpe\u010dnostn\u00edch p\u00e1s\u016f, v\u010detn\u011b p\u00e1s\u016f, spon, nav\u00edje\u010d\u016f, pyrotechnick\u00fdch za\u0159\u00edzen\u00ed.<\/i><\/li>\n<li><i><b>Sedadla<\/b><\/i><i>, kter\u00e1 jsou vybavena kotevn\u00edmi \u00fachyty bezpe\u010dnostn\u00edch p\u00e1s\u016f a\/nebo airbagy.<\/i><\/li>\n<li><i>Z\u00e1mky \u0159\u00edzen\u00ed p\u016fsob\u00edc\u00ed na sloupek \u0159\u00edzen\u00ed.<\/i><\/li>\n<li><i>Imobiliz\u00e9ry, v\u010detn\u011b transpond\u00e9r\u016f a elektronick\u00fdch \u0159\u00eddic\u00edch jednotek.<\/i><\/li>\n<\/ul>\n<p>EU na to tedy jde chyt\u0159e, proto\u017ee \u017e\u00e1dn\u00e9 \u201ez\u00e1kazy oprav\u201c vyd\u00e1vat nebude. Pouze v\u00e1m znemo\u017en\u00ed auto opravit, a to na z\u00e1klad\u011b vhodn\u011b vybran\u00fdch krit\u00e9ri\u00ed. Pro va\u0161e dobro, samoz\u0159ejm\u011b. P\u0159estane-li v\u00fdrobce dod\u00e1vat nap\u0159\u00edklad airbagy nebo v\u00fdfuky (jak dlouho bude je\u0161t\u011b povolen\u00e1 druhov\u00fdroba, o jej\u00ed\u017e z\u00e1kaz se automobilky u\u017e dlouhou dobu sna\u017e\u00ed, kter\u00e1 ale u\u017e nyn\u00ed neobsahuje zdaleka v\u0161e?), nemo\u017enost jejich pou\u017eit\u00ed z\u00a0jin\u00e9ho auta povede k\u00a0tomu, \u017ee bude auto \u201etechnicky neopraviteln\u00e9\u201c a vyr\u00e1\u017e\u00edte na \u0161ro\u0165\u00e1k nikoliv pro d\u00edly, ale odevzdat to sv\u00e9.
