Star\u00fd z\u00e1kon o vyvlast\u0148ov\u00e1n\u00ed umo\u017e\u0148uje toti\u017e jen vyvlast\u0148ov\u00e1n\u00ed staveb a pozemk\u016f, nikoliv jednotliv\u00fdch separ\u00e1tn\u00edch byt\u016f ve stavb\u011b! A je to venku! Aeronet jako prvn\u00ed odhaluje d\u011bsivou novelu, kter\u00e1 p\u0159ich\u00e1z\u00ed doslova jako na zavolanou v dob\u011b obrovsk\u00e9 migrace Ukrajinc\u016f a vyvol\u00e1v\u00e1 logick\u00e9 ot\u00e1zky s jejich ubytov\u00e1n\u00edm!<\/h4>\n<p>Na\u0161e redakce byla v \u00fater\u00fd op\u011bt informov\u00e1na na\u0161im extern\u00edm zdrojem, \u017ee na vl\u00e1du Petra Fialy dorazil explozivn\u00ed n\u00e1vrh na novelu Vyvlast\u0148ovac\u00edho z\u00e1kona z ministerstva pro m\u00edstn\u00ed rozvoj, kter\u00e9mu \u0161\u00e9fuje ministr a p\u0159edseda Pir\u00e1tsk\u00e9 strany Ivan Barto\u0161.\u00a0<strong>Dostali jsme do ruky kompletn\u00ed kompilaci podan\u00e9ho n\u00e1vrhu v\u010detn\u011b dokument\u016f k p\u0159ipom\u00ednkov\u00e9mu \u0159\u00edzen\u00ed a rovn\u011b\u017e d\u016fvodovou zpr\u00e1vu.<\/strong><\/p>\n<p>V \u010cesk\u00e9 republice ji\u017e z\u00e1kon o vyvlastn\u011bn\u00ed existuje, poch\u00e1z\u00ed z roku 2006 a dlouho se s n\u00edm neh\u00fdbalo, p\u0159esto\u017ee v mnoha p\u0159\u00edpadech staveb ve\u0159ejn\u00e9ho z\u00e1jmu se opr\u00e1vn\u011bn\u011b ob\u010dan\u00e9 roz\u010dilovali, \u017ee n\u011bkdo t\u0159eba blokuje v\u00fdstavbu d\u00e1lnice t\u00edm, \u017ee nechce prodat pozemek, proto\u017ee za n\u011bj po\u017eaduje horentn\u00ed nadhodnotu t\u0159eba sto-n\u00e1sobku jeho tr\u017en\u00ed ceny apod. Vyvlast\u0148ov\u00e1n\u00ed ve ve\u0159ejn\u00e9m z\u00e1jmu za tr\u017en\u00ed cenu nen\u00ed v podstat\u011b nic proti ni\u010demu, je-li ten z\u00e1jem opravdu zna\u010dn\u00fd. Jen\u017ee, samotn\u00fd z\u00e1kon\u00a0\u010d. 184\/2006 Sb. o\u00a0odn\u011bt\u00ed nebo omezen\u00ed vlastnick\u00e9ho pr\u00e1va k\u00a0pozemku nebo ke stavb\u011b, byl p\u016fvodn\u011b zam\u00fd\u0161len k vyvlast\u0148ov\u00e1n\u00ed pozemk\u016f a staveb jako takov\u00fdch, tedy komplexn\u00edch budov, kdy vyvlastn\u011bn\u00ed se t\u00fdkalo budovy jako celku a vlastn\u00edk budovy byl p\u0159edm\u011btem vyjedn\u00e1v\u00e1n\u00ed, aby objekt prodal st\u00e1tu ve ve\u0159ejn\u00e9m z\u00e1jmu. Pokud vlastn\u00edkem budovy je SVBJ (sdru\u017een\u00ed vlastn\u00edk\u016f bytov\u00fdch jednotek), potom p\u0159edm\u011btem vyjedn\u00e1v\u00e1n\u00ed je jmenovan\u00fd z\u00e1stupce tohoto sdru\u017een\u00ed.<\/p>\n<h6><span style=\"font-size: 18pt;\">Nov\u00fd z\u00e1kon o vyvlast\u0148ov\u00e1n\u00ed umo\u017en\u00ed vyvlast\u0148ovat i jednotliv\u00e9 byty, nejen budovy jako celky<\/span><\/h6>\n<p>P\u0159edstavte si nap\u0159. panel\u00e1k na m\u00edst\u011b budouc\u00edho t\u011b\u017eebn\u00edho prostoru pro povrchov\u00fd d\u016fl, kde se bude t\u011b\u017eit uhl\u00ed. Jednotliv\u00ed majitel\u00e9 byt\u016f dostali nab\u00eddky na odkup, a ti, kte\u0159\u00ed neprodali, tak proti t\u011bm se potom vedlo vyvlast\u0148ovac\u00ed \u0159\u00edzen\u00ed. Jen\u017ee, je tady jeden h\u00e1\u010dek. Ten star\u00fd vyvlast\u0148ovac\u00ed z\u00e1kon umo\u017e\u0148oval v\u017edy jen vyvlast\u0148ovat budovu jako celek. Pokud jde tedy o panel\u00e1k, tak se t\u00edm mysl\u00ed komplet v\u0161echny byty v panel\u00e1ku, bez v\u00fdjimky. Jen\u017ee, to, co na\u0161e redakce objevila v d\u016fvodov\u00e9 zpr\u00e1v\u011b z d\u00edlny Ivana Barto\u0161e, z toho n\u00e1m p\u0159e\u0161el doslova mr\u00e1z po z\u00e1dech.<\/p>\n<p>Na stran\u011b \u010d. 26 d\u016fvodov\u00e9 zpr\u00e1vy se uv\u00e1d\u00ed:<\/p>\n<p>Ustanoven\u00ed upravuj\u00edc\u00ed p\u0159edm\u011bt z\u00e1kona a vymezuj\u00edc\u00ed z\u00e1kladn\u00ed pojmy nereflektuje zm\u011bny, kter\u00e9 vnesl do pr\u00e1vn\u00edho \u0159\u00e1du zejm\u00e9na z\u00e1kon \u010d. 89\/2012 Sb., ob\u010dansk\u00fd z\u00e1kon\u00edk, nap\u0159. \u00fapravou bytov\u00e9ho spoluvlastnictv\u00ed. Vyvlastn\u011bn\u00edm z\u00e1kon rozum\u00ed odn\u011bt\u00ed nebo omezen\u00ed vlastnick\u00e9ho pr\u00e1va k\u00a0pozemku nebo ke stavb\u011b,\u00a0<strong>av\u0161ak jednotka podle ob\u010dansk\u00e9ho z\u00e1kon\u00edku (\u00a7 1159), pop\u0159\u00edpad\u011b podle (ji\u017e zru\u0161en\u00e9ho) z\u00e1kona o vlastnictv\u00ed byt\u016f \u010d. 72\/1994 Sb. stavbou nen\u00ed.<\/strong>\u00a0V\u00a0souvislosti s\u00a0p\u0159edm\u011btem vyvlastn\u011bn\u00ed se nezmi\u0148uje pr\u00e1vo stavby jako v\u011bcn\u00e9 pr\u00e1vo k\u00a0ciz\u00ed v\u011bci umo\u017e\u0148uj\u00edc\u00ed jeho dr\u017eiteli z\u0159\u00eddit stavbu na ciz\u00edm pozemku. Pro jeho z\u0159\u00edzen\u00ed, zru\u0161en\u00ed \u010di omezen\u00ed nelze analogicky pou\u017e\u00edt \u00fapravu vyvlastn\u011bn\u00ed t\u00fdkaj\u00edc\u00ed se v\u011bcn\u00e9ho b\u0159emene.<\/p>\n<p>Po p\u0159e\u010dten\u00ed tohoto zd\u016fvodn\u011bn\u00ed n\u00e1m v redakci doslova spadla brada a hned po n\u00ed hodiny ze zdi. Pro\u010d pot\u0159ebuje \u010desk\u00fd st\u00e1t najednou vyvlast\u0148ovat samostatn\u00e9 bytov\u00e9 jednotky v panel\u00e1ku? Copak v z\u00e1jmu ve\u0159ejn\u00e9 stavby nebo ve\u0159ejn\u00e9ho d\u00edla je pot\u0159eba vyvlast\u0148ovat jednotliv\u00e9 byty a nikoliv cel\u00fd panel\u00e1k skrze jedn\u00e1n\u00ed se SVBJ? Co je t\u00edm proboha sledov\u00e1no? Ano, jedn\u00e1 se o novelu, kter\u00e1 m\u00e1 umo\u017enit vyvlast\u0148ov\u00e1n\u00ed jednotliv\u00fdch byt\u016f\u00a0<em>per se<\/em>, nam\u00edsto cel\u00fdch budov a cel\u00fdch komplex\u016f. To se d\u00e1 sice zd\u016fvodnit t\u00edm, \u017ee st\u00e1t chce m\u00edt mo\u017enost jednat s ka\u017ed\u00fdm majitelem bytu v panel\u00e1ku o odkoupen\u00ed jednotliv\u011b, aby st\u00e1t nemusel jednat se z\u00e1stupcem SVBJ, kter\u00fd dostane od majitel\u016f byt\u016f mand\u00e1t k vyjedn\u00e1v\u00e1n\u00ed o ur\u010dit\u00e9 cen\u011b za objekt jako celek.<\/p>\n<h6><span style=\"font-size: 18pt;\">Pokud novela bude schv\u00e1lena v navrhovan\u00e9m zn\u011bn\u00ed, bude hrozit prolomen\u00ed majetkov\u00e9ho pr\u00e1va i tam, kde si to dosud nikdo nedok\u00e1zal p\u0159edstavit<\/span><\/h6>\n<p>Jen\u017ee, na stran\u011b druh\u00e9 takov\u00e1 novela z\u00e1kona umo\u017en\u00ed vyvlast\u0148ovat v panel\u00e1ku pouze jednotliv\u00e9 vybran\u00e9 byty, nap\u0159. velkometr\u00e1\u017en\u00ed byty, dlouho neobydlen\u00e9 byty, kde nikdo nebydl\u00ed, proto\u017ee majitel byt dr\u017e\u00ed jako investici, t\u00edmto zp\u016fsobem p\u016fjde ve ve\u0159ejn\u00e9m z\u00e1jmu o humanit\u00e1rn\u00ed pomoc Ukrajinc\u016fm v \u010cR vyvlast\u0148ovat nap\u0159. neobydlen\u00e9 byty investor\u016f, ani\u017e by st\u00e1t musel vyvlast\u0148ovat cel\u00fd panel\u00e1k jako celek. Bum\u2026 a je to venku! Podle na\u0161eho pr\u00e1vn\u00edka jde pr\u00fd zjevn\u011b o snahu p\u0159ijet\u00ed z\u00e1konn\u00e9ho r\u00e1mce pro p\u0159\u00edpadn\u00e9 c\u00edlen\u00e9 vyvlast\u0148ov\u00e1n\u00ed pod\u00edlov\u00e9ho vlastnictv\u00ed mimo r\u00e1mec SVBJ, p\u0159i\u010dem\u017e v d\u016fvodov\u00e9 zpr\u00e1v\u011b a v tom sam\u00e9m citovan\u00e9m odstavci je je\u0161t\u011b jeden d\u016fvod.<\/p>\n<figure id=\"attachment_54269\" class=\"wp-caption aligncenter\" style=\"width: 699px;\"><a href=\"https:\/\/aeronet.news\/wp-content\/uploads\/VyvlastneniDuvodovka.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"wp-image-54269 \" src=\"https:\/\/aeronet.news\/wp-content\/uploads\/VyvlastneniDuvodovka.jpg\" sizes=\"(max-width: 700px) 100vw, 700px\" srcset=\"https:\/\/aeronet.news\/wp-content\/uploads\/VyvlastneniDuvodovka.jpg 700w, https:\/\/aeronet.news\/wp-content\/uploads\/VyvlastneniDuvodovka-266x300.jpg 266w, https:\/\/aeronet.news\/wp-content\/uploads\/VyvlastneniDuvodovka-316x357.jpg 316w, https:\/\/aeronet.news\/wp-content\/uploads\/VyvlastneniDuvodovka-428x483.jpg 428w\" alt=\"\" width=\"699\" height=\"789\" \/><\/a><figcaption class=\"wp-caption-text\">\u00daryvek ze strany \u010d. 26 d\u016fvodov\u00e9 zpr\u00e1vy k n\u00e1vrhu novely<\/figcaption><\/figure>\n<p>Ve star\u00e9m z\u00e1kon\u011b toti\u017e nen\u00ed mo\u017en\u00e9 vyvlastnit formou pr\u00e1va stavby na ciz\u00edm pozemku, kter\u00fd p\u0159itom z\u016fstane v majetku vlastn\u00edka, ale st\u00e1t si vyvlastn\u00ed pr\u00e1vo um\u00edstit na n\u011bm vlastn\u00ed stavbu, t\u0159eba do\u010dasnou vojensku z\u00e1kladnu NATO, do\u010dasn\u00fd uprchlick\u00fd stanov\u00fd t\u00e1bor pro 10 000 migrant\u016f, do\u010dasnou stavbu komunika\u010dn\u00ed v\u011b\u017ee NATO, do\u010dasn\u00e9ho vojensk\u00e9ho radaru NATO atd.<\/p>\n<p><strong>P\u016fvodn\u00ed star\u00fd z\u00e1kon toto neumo\u017e\u0148uje, ten toti\u017e \u0159e\u0161\u00ed jen vyvlastn\u011bn\u00ed cel\u00e9ho pozemku se v\u0161\u00edm v\u0161udy, co\u017e ne v\u017edy st\u00e1t pot\u0159ebuje<\/strong>, nap\u0159. na poli, kter\u00e9 m\u00e1 800 hektar\u016f, kde chce st\u00e1t uprost\u0159ed postavit radar v\u010dasn\u00e9ho varov\u00e1n\u00ed, ale nepot\u0159ebuje cel\u00e9 pole. St\u00e1t tedy pot\u0159ebuje uplatnit vyvlast\u0148ovac\u00ed pr\u00e1vo na pr\u00e1vo stavby na ciz\u00edm pozemku, p\u0159i\u010dem\u017e vyvlastn\u011bn\u00edm se mysl\u00ed jen pr\u00e1vo t\u00e9 stavby, nikoliv p\u0159evod pozemku jako celku do majetku st\u00e1tu.<\/p>\n<h6><span style=\"font-size: 18pt;\">Vyvlastn\u011bn\u00fd majitel dostane n\u00e1hradou maxim\u00e1ln\u011b 8-n\u00e1sobek odhadn\u00ed ceny. To je hodn\u011b, ale i stra\u0161n\u011b m\u00e1lo\u2026<\/span><\/h6>\n<p>Novela z\u00e1kona o vyvlastn\u011bn\u00ed zav\u00e1d\u00ed pravidlo, \u017ee\u00a0<strong>vyvlastnitel m\u016f\u017ee vyvlast\u0148ovan\u00e9mu majiteli pozemku, stavby \u010di bytov\u00e9 jednotky nab\u00eddnout maxim\u00e1ln\u011b 8-n\u00e1sobek m\u00edstn\u011b b\u011b\u017en\u00e9 tr\u017en\u00ed ceny.<\/strong>\u00a0T\u00edm dojde k zastropov\u00e1n\u00ed v\u00fdkupn\u00edch cen, tak\u017ee kdo bude vlastnit \u00fa\u010detn\u011b bezcenn\u00fdch 100 metr\u016f \u010dtvere\u010dn\u00edch orn\u00e9 p\u016fdy za 3 000 K\u010d (30 K\u010d za metr \u010dtvere\u010dn\u00ed), kter\u00fd br\u00e1n\u00ed stavb\u011b d\u00e1lnice, u\u017e nebude moci za ten pozemek po\u017eadovat ston\u00e1sobek b\u011b\u017en\u00e9 ceny (300 000 K\u010d), ale maxim\u00e1ln\u011b 8-n\u00e1sobek (24 000 K\u010d). A to nen\u00ed b\u016fhv\u00ed co pro p\u016fvodn\u00edho majitele. To je holomajzna. Tedy v p\u0159\u00edpad\u011b, \u017ee denn\u00ed tempo p\u0159\u00edlivu Ukrajinc\u016f do \u010cR se nezmen\u0161\u00ed, jak jsme uvedli v \u010dl\u00e1nku\u00a0<strong><a href=\"https:\/\/aeronet.news\/za-jediny-den-prislo-do-cr-vice-jak-7-000-ukrajincu-a-podle-vnitra-jich-je-celkove-v-cesku-uz-bezmala-700-000-pricemz-kazdy-den-jich-v-prumeru-prichazi-2-500-timto-tempem-jich-prijde-kazdy-mesic\/\">zde<\/a><\/strong>. V\u0161echno to najednou zapad\u00e1 dokonale do sebe jako konceptu\u00e1ln\u00ed puzzle. Kdykoliv se n\u011bkde objevuje z\u00e1kon o vyvlast\u0148ov\u00e1n\u00ed ve ve\u0159ejn\u00e9m z\u00e1jmu, je to v\u017edy s obrovsk\u00fdm rizikem, co pod t\u00edm bude my\u0161leno, proto\u017ee ve\u0159ejn\u00fd z\u00e1jem je obrovsky rozevl\u00e1t\u00fd pojem s mohutn\u00fdm rozp\u011bt\u00edm. Lze za ve\u0159ejn\u00fd z\u00e1jem pova\u017eovat omezov\u00e1n\u00ed vlastnick\u00fdch pr\u00e1v zd\u016fvodn\u011bn\u00e9 sanac\u00ed bytov\u00e9 krize v zemi zp\u016fsoben\u00e9 nezodpov\u011bdnou migra\u010dn\u00ed politikou vl\u00e1dy? Toto jsou z\u00e1sadn\u00ed ot\u00e1zky, kter\u00e9 se vzn\u00e1\u0161\u00ed nad velice nebezpe\u010dnou a snadno zneu\u017eitelnou novelou Vyvlast\u0148ovac\u00edho z\u00e1kona.<\/p>\n<h6><span style=\"font-size: 18pt;\">Novela nedefinuje, \u017ee vyvlast\u0148ovatelem m\u016f\u017ee b\u00fdt jenom a pouze \u010desk\u00fd st\u00e1t, ale m\u016f\u017ee j\u00edm b\u00fdt prakticky kdokoliv, pokud prok\u00e1\u017ee, \u017ee jeho projekt je ve ve\u0159ejn\u00e9m z\u00e1jmu<\/span><\/h6>\n<p>Rovn\u011b\u017e n\u00e1s znepokojuje, \u017ee nikde v novele nen\u00ed explicitn\u011b uvedeno, \u017ee vyvlast\u0148ovatelem m\u016f\u017ee b\u00fdt jedin\u011b a pouze st\u00e1t, resp. dan\u00e9 ministerstvo, proto\u017ee v z\u00e1kon\u011b se hovo\u0159\u00ed o vyvlastniteli v obecn\u00e9 rovin\u011b ve\u0159ejn\u00e9ho z\u00e1jmu. Pokud je institut vyvlastn\u011bn\u00ed sm\u011brov\u00e1n proti vlastn\u00edk\u016fm budov a pozemk\u016f, lze se na to po\u0159\u00e1d d\u00edvat jako na ve\u0159ejn\u00fd z\u00e1jem, pokud se na dan\u00e9m m\u00edst\u011b m\u00e1 stav\u011bt t\u0159eba d\u00e1lnice.<\/p>\n<p><strong>Ov\u0161em pokud z\u00e1kon umo\u017en\u00ed vyvlast\u0148ovat nejen budovy jako celky, ale i jednotliv\u00e9 bytov\u00e9 jednotky v budov\u011b, tedy separ\u00e1tn\u011b odd\u011blen\u00e9 od budovy jako takov\u00e9, potom se dost\u00e1v\u00e1me do \u00fapln\u011b jin\u00e9ho p\u0159\u00edb\u011bhu<\/strong>, a to zvl\u00e1\u0161t\u011b v dob\u011b, kdy \u010cR \u010del\u00ed nejv\u011bt\u0161\u00ed migra\u010dn\u00ed vln\u011b ve sv\u00e9 historii a lid\u00e9 se ptaj\u00ed on\u00edm Nerudovsk\u00fdm r\u010den\u00edm: \u201c<em>Kam s nimi?<\/em>\u201d a nikdo nezn\u00e1 p\u0159esnou odpov\u011b\u010f. V \u010cesku je nedostatek byt\u016f pro mlad\u00e9 rodiny. Kde se vezme bydlen\u00ed pro sou\u010dasn\u00fdch skoro 700 000 Ukrajinc\u016f, kte\u0159\u00ed ji\u017e v \u010cR jsou, anebo pro 1,6 milionu Ukrajinc\u016f koncem roku 2023, pokud sou\u010dasn\u00e9 tempo p\u0159\u00edlivu migrant\u016f z Ukrajiny z\u016fstane na sou\u010dasn\u00e9 \u00farovni? To je ot\u00e1zka, za kterou se skr\u00fdv\u00e1 mnoho d\u011bsiv\u00fdch odpov\u011bd\u00ed.
